Contaminated land and remediation conditions on UK planning decision notices
Brownfield permissions often chain ground investigation, remediation schemes, verification reports and post-completion monitoring in numbered conditions. Developers read these clauses to schedule consultants and strip costs — not to interpret soil chemistry from a guide. This page is sealed-notice literacy only.
Typical condition sequence
- Desk study / Phase 1 — sometimes pre-commencement.
- Intrusive investigation — may be before or during works depending on trigger.
- Remediation scheme approval — often before exposing contamination.
- Verification and sign-off — may be pre-occupation — see pre-commencement vs pre-occupation.
Compare with contamination condition sequence patterns on other notices and archaeology conditions which may run in parallel on the same site.
Common printed phrases
| Wording | Reading note |
|---|---|
| No development until remediation strategy approved | Hard stop before earthworks |
| Unexpected contamination | Stop-work and notify — procedural clause |
| Verification report to LPA | Completion milestone — check pre-occupation label |
| Gas protection measures | May link to membrane details and structures |
| Monitoring wells / groundwater | Ongoing obligation — duration on notice |
Links to drainage and ecology
Excavation may interact with SuDS and habitat triggers — drainage and flood risk conditions, ecology and wildlife survey conditions. Read each numbered condition; do not merge remedial tasks without reading triggers.
Materials and waste on site
Reuse of excavated material on site may appear under materials or waste conditions — materials conditions, waste management conditions.
Discharge and approval wording
“Details pursuant to condition X” language means discharge before the trigger event — which conditions need discharge, how to read condition timing.
Sealed notice discipline
Quote condition numbers and trigger labels exactly — decision notice vs officer report, where to find sealed notices.
Questions
Is a Phase 2 survey always pre-commencement?
Many notices require investigation or remediation plans before commencement, but wording varies. Read the sealed trigger on your permission — do not assume from other schemes.
How is this different from drainage conditions?
Drainage conditions target SuDS and flood risk; contaminated land conditions target ground investigation, remediation and verification. Both may appear on brownfield permissions.
Will DecisionBrief commission remediation?
No. DecisionBrief reads sealed decision notices. Remediation design is for contaminated land specialists.
